Probate is a court proceeding whereby the issues of the Estate are settled and the property of the deceased is distributed according to the Last Will, or according to State law of there is no Last Will. Probate is not necessary when there are no probate assets, and oftentimes not necessary when the size of the estate is small (less than $50,000.00). Probate fees formerly were very expensive and based upon a percentage of the estate. Modern probate proceedings are now done a per hour basis, which has greatly reduced the cost. Probate attorneys are skilled at resolving intra-family disputes. A death in the family can often bring on squabbles and disagreements that an be quickly put to rest by a skilled probate attorney. After 40 years of practice, I have the skills needed to navigate these intra-family issues.
